Córdoba: la Justicia la mandó a estudiar
La madre de una estudiante de quinto año acudió a La Justicia presentando un amparo que anulara los exámenes desaprobados de su hija, que la obligaban a repetir el año de la secundaria, y el organismo lo rechazó.
Al contrario de lo solicitado por la mujer, la jueza de Conciliación de 5ta. Nominación de Córdoba, Victoria Bertosi de Lorenzati, rechazó el amparo; respaldó lo actuado por los docentes de la escuela en cuestión y argumentó que el caso hizo evidente “falta de apego a las reglas educativas” y “ausencia de responsabilidad” por parte de la alumna por no preocuparse antes del examen en contar con el programa de cada materia.
Es que en el planteo del amparo, la madre de la adolescente reprobada, denunció que como la escuela no había provisto los programas de las materias en cuestión (Geografía e Inglés), su hija había visto vulnerado el derecho a aprender. Con ese argumento la mujer reclamó por la vía administrativa que se anularan los exámenes y que se los tomaran de nuevo, lo que fue rechazado por las autoridades del Colegio Gabriel Taborín, ubicado en avenida Sabattini, en la ciudad de Córdoba. En la apelación judicial también le fue mal.
Con cuatro previas
La jueza analizó la foja curricular de la alumna y advirtió que adeudaba cuatro materias (una de cuarto año y tres de quinto) y que la institución educativa le había ofrecido “la modalidad de cursado prevista para los alumnos repitentes del ciclo lectivo 2016”.
La jueza también tuvo en cuenta que el 16 de marzo pasado la Dirección General de Institutos Privados de Enseñanza había concluido que es atribución del director del colegio anular una mesa de examen y que, en este caso, el directivo consideró que no había motivos que justificaran tal medida.
En ese sentido, la jueza destacó que la escuela hizo lo que tenía que hacer para garantizarle a la alumna la absoluta regularidad de la evaluación, y que “nada” había dicho la alumna en el momento del examen acerca de las “falencias” que luego denunció.
La magistrada aseguró que el colegio ofrece los programas al inicio del año lectivo y los dispone en su página de Internet. “Si K. (el nombre de la adolescente queda en reserva) recién se preocupó del programa horas antes del examen, (quiere decir que) se tuvo demasiada confianza o, bien, marcó desinterés sobre sus contenidos. En consecuencia, no se violentó el derecho a ‘aprender’. Sí se evidenció la falta de apego a las reglas educativas de la institución, la ausencia de responsabilidad de contar, desde el inicio de clases, con el programa de materias”, añadió.
También añadió la juez que admitir un amparo de este tipo podría provocar un aluvión de planteos similares de padres cuyos hijos resultan desaprobados.
