Definen si habrá juicio por falso testimonio por la muerte de Débora Pérez Volpin
Es un día clave para el caso de la muerte de la periodista Débora Pérez Volpin. La Justicia debe definir si hace lugar o no a la presentación que hicieron el director médico del Sanatorio La Trinidad Roberto Martingano y la instrumentadora quirúrgica Miriam Eliana Frías.
Martingano y Frías pidieron frenar el inicio del juicio por falso testimonio y el médico solicitó cumplir una probation. De concederse este recurso evitarían el proceso, algo a lo que se opone la familia de la periodista que murió en 2018 mientras se sometía a una endoscopia.

El abogado de la familia de la víctima, Diego Pirota, explicó en Arriba Argentinos que la fiscalía se opuso a la presentación. Aclaró que la ley establece que cuando hay oposición del Ministerio Público Fiscal “no debe concederse la probation”.
Pirota dijo que no cree que el Tribunal vaya a concederles la probation a Martingano y a Frías: “Es raro prensar que pueda resolver algo distinto”. Mencionó que ambos están procesados por encubrimiento y por falso testimonio.
El abogado de la familia de Pérez Volpin explicó que si el tribunal hace lugar a la medida el médico solo haría “un año de tareas comunitarias”.
Pirota explicó que a Martingano “se le imputa un delito doloso”. Dijo que el director médico de la Trinidad de Palermo “quiso encubrir el homicidio, tuvo intención y el conocimiento de hacerlo”.
El abogado de la familia de Pérez Volpin criticó que Martingano “ahora quiere evitar el juicio” y mencionó que después de la muerte de la periodista “quiso encubrir la escena del crimen, con actitud premeditada y pleno dominio del hecho”.
Cerca de un mes atrás el director médico de la clínica y la instrumentadora quirúrgica pidieron frenar el inicio del procedimiento que podría condenarlos por falso testimonio.
Pirota explicó en Arriba Argentinos que el médico además ofreció “tareas comunitarias, una indemnización y auto inhabilitarse por un año para ejercer la medicina”.
El abogado de la familia de Pérez Volpin aclaró que Martingano está imputado como director de la clínica y no por haber intervenido como médico: “Están queriendo evitar el juicio porque si marcha, sería inevitable que les cayera una condena a los dos”.
