Grave imputación al sospechoso de instigar el crimen de Zulatto
Andrés Soza Bernard fue acusado ayer en una audiencia en Tribunales. Un juez le dictó la prisión preventiva sin plazos y lo mandó a Piñero.
El hombre de 31 años acusado de instigar y participar del asesinato de Fabricio Zulatto, hallado muerto con tres tiros en la cabeza el 11 de agosto en un rancho de Génova al 2100, quedó imputado de homicidio calificado por promesa remunerativa y agravado por el uso de arma de fuego. Durante la audiencia celebrada ayer en Tribunales, el acusado (en libertad condicional desde 2014 por una condena a 13 años de prisión por matar a su novia en 2008) se declaró inocente. Sobre el video donde se lo ve estacionar y descender del auto de la víctima, evidencia que lo conecta directamente al hecho, dijo que lo trasladó desde la escena del delito a cambio de “droga gratis” (ver aparte). El juez tildó de “pueril” ese argumento, indicó que hay “serias evidencias que conducen irremediablemente al acusado” y ordenó su prisión preventiva por el plazo máximo de ley. Además se confirmó que existía un trato asiduo entre la víctima y alguno de sus amigos con el sindicado victimario, a quien contactaban para comprarle droga. El móvil del homicidio se habría gestado en un “conflicto económico” porque el acusado manifestó estar “perseguido” respecto a que Zulatto le iba a robar.
Con una serie de evidencias concretas que se basan en declaraciones de dos testigos de identidad reservada y amigos de la víctima, un arrepentido coimputado de encubrimiento y el video filmado en Suipacha al 700, el fiscal Adrián Spelta acusó ayer a Andrés Soza Bernard por el crimen de Zulatto, el chico de 21 años que jugaba fútbol de salón en Newell’s Old Boys y apareció asesinado dentro de un pozo ciego de un rancho de Génova al 2100.
Soza Bernard fue detenido el miércoles a la noche en la casa de su madre, en Nicaragua 1193 A, y ayer fue trasladado a Tribunales señalado como el instigador y autor intelectual del homicidio.
Desde las 11.50, y ante el juez Héctor Núñez Cartelle, el sospechoso atravesó el trámite de imputación junto a sus abogados, Ignacio Carbone y Juan Ubiedo. Mientras afuera de la sala quedaron varios amigos de Fabricio, en la primea fila del recinto se sentaron su hermana, María Sol, la novia y la suegra del joven. En el sector opuesto, la madre del imputado escuchó la audiencia casi acurrucada en una silla.
La acusación. El fiscal elaboró su idea del caso al describir que “el 9 de agosto, alrededor de las 17, y en comunidad de acción con otras personas, Soza Bernard se hizo conducir por la víctima al búnker de Génova al 2100 donde los esperaba Omar Darío “Pilo” M. (coimputado), con quien ya había acordado el asesinato de Fabricio por 20 mil pesos”.
El fiscal ventiló detalles y refrescó declaraciones de testigos directos del caso que ayudaron a esclarecerlo y a entender, al menos por ahora, la naturaleza del conflicto que desencadenó la violenta muerte.
Según las evidencias, Zulatto y un grupo de amigos tenía contacto directo con Soza Bernard, a quien recurrían para que les suministrara estupefacientes. Los encuentros se pactaban a veces en la zona de Santa Fe y Vera Mujica, otras en Suipacha y Tucumán.
Pero el joven asesinado también habría trasladado en su auto varias veces al supuesto dealer a Génova al 2100. Así se desprende de la declaración de un testigo de identidad reservada que ayer mencionó el fiscal.
“Una vez pasamos a buscarlo por Suipacha y Tucumán. Yo dejé mi auto y fuimos los tres en el de Fabricio hasta una villa que, según entiendo, es muy cerca de donde encontraron el cuerpo. En ese lugar Andrés tenía un búnker donde iba a buscar plata. «Quédense tranquilos, ya saben que llegué yo»”, ostentó el acusado en un lugar riesgoso para foráneos. “En un par de ocasiones Fabricio lo llevó en su auto y le pagaron con merca”, agregó el informante.
En sintonía con esas declaraciones, a la vuelta de uno de esos viajes se habría generado un conflicto y discusión entre Andrés y Fabricio. Eso quedó demostrado cuando Soza Bernard le mandó un mensaje a un tercero conocido en común donde advertía: “¿Qué le pasa a tu amigo? Tengo ganas de pegarle un tiro”.
El arrepentido. Para el fiscal Spelta resultó valioso además el relato del acusado de encubrimiento y arrepentido, una persona de escasos recursos que fue convocada circunstancialmente para tapar con tierra el pozo donde hallaron a Fabricio.
Se trata de José Luis G., quien contó con detalles el último tramo del crimen. Esa persona dijo que el 9 de agosto regresaba de la cooperativa barrial donde trabaja cuando al pasar por el rancho donde «venden» se topó con Andrés y Pilo. “Tenían las remeras y los pantalones manchados con sangre”, contó. “Estaban tapando un pozo y me pidieron que siguiera yo. Tuve que acarrear tres carretillas. En un momento Andrés le dijo a Pilo: «En un rato te voy a traer la plata, los 20 mil pesos”, escuchó José Luis.
Al ingresar a la casa también observó “cuajos de sangre”. Explicó que la casilla era de Andrés, que llegó a esa zona “hace 8 años. Venía seguido porque bajaba la droga, las bolsas de fasos para que vendamos”.
El hombre también contó que no quería ir más a ese lugar porque “sentía que algo iba a pasar. Andrés ya había dicho que traería a alguien. Andrés daba la plata para que mataran a esa persona”, reiteró.
En ese contexto, según la interpretación que hizo el fiscal, es “más lógico pensar, por las apariencias y recursos económicos, que los otros dos coimputados son el último eslabón en la cadena de venta de estupefacientes y no como Soza Bernard pretende hacernos creer, que es él”.
“Esto no es un dato menor. Los testigos amigos de la víctima cuentan que el conflicto entre Bernard y la víctima comienza apróximadamente hace un mes a raíz de una diferencia que tuvieron dentro de un vehículo porque aparentemente Soza Bernard se sentía perseguido con que le iba a robar”, insistió Spelta.
Esa hipótesis explica en parte el vínculo entre los protagonistas, la compleja trama de consumo y distribución de droga y las violentas consecuencias que acarrea entrometerse en un submundo que muchos subestiman.
El funcionario escogió la figura de “homicidio calificado por haber sido cometido por precio o promesa remunerativa, agravado por el uso de arma de fuego con aptitud para el disparo”. Y pidió para el imputado la prisión preventiva por el plazo máximo de ley. Argumentó ese pedido en los supuestos de apariencia de responsabilidad en el hecho, la peligrosidad procesal, el peligro de fuga y la pena en expectativa (pena máxima de prisión o reclusión perpetua).
Incongruencia. A su turno los abogados defensores objetaron la calificación legal. “Hay incongruencia. No es compatible la promesa remuneratoria con la coautoría”. Y sostuvieron que “haber dejado un auto no demuestra la autoría”, del homicidio. “Tampoco hay evidencia de la promesa remunerada”, plantearon.
Carbone puso en duda la legalidad de la declaración del imputado de encubrimiento José Luis G. “Es un sujeto particular. Nos genera muchas dudas. Lo detuvieron con Pilo y su declaración en sede policial es inválida. A esta defensa le hace ruido porque después de declarar y endilgar la autoría a otro quedó en una mejor situación procesal. Esa persona deber ser investigada”, reclamó el profesional.
Por otra parte, relativizó “los datos de calle” y los aportados por testigos de identidad reservada. “En principio se dijo que Fabricio tenía problemas con un tal Mauro. Eso no se investigó”, fustigó Carbone. Y anticipó que la sangre hallada en las prendas secuestradas a Soza Bernard al ser detenido no es de la víctima, sino que corresponden a su cliente porque “tiene hemorragias nasales”.
El abogado solicitó la prisión domiciliaria del acusado. Para demostrar arraigo, dijo que no se fugará ni entorpecerá la investigación y recordó que trabaja en una empresa ubicada en Ayacucho al 3200.
“No es vendedor de droga. Tiene un trabajo estable y títulos de licenciatura en comercio exterior y en comercio aduanero. Ahora cursa el 4º año de la carrera de contador en la Universidad del Centro Educativo Latinoamericano (Ucel)”, recordó Carbone sobre la formación de su cliente.
“Pueril” defensa. Luego de escuchar cómo la Fiscalía defendió la validez de la evidencia, el juez Núñez Cartelle avaló la imputación a Soza Bernard. “La calificación legal no es incompatible por más que no se haya concretado el pago, igual lo hace partícipe como coautor”, argumentó de entrada.
Luego de recordar el video donde se lo ve dejar el auto y destacar los certeros datos de calle que orientaron la pesquisa, puntualizó que “hay serias evidencias que conducen irremediablemente al acusado”.
Y calificó sin pelos en la lengua de “pueril e infantil la defensa que hizo el acusado” al decir que hizo ese “favor” de llevar el auto de la víctima “sin patente y sin preguntar, en una transacción por sustancias alcaloides”.
El magistrado rechazó el pedido de la defensa y ordenó la prisión preventiva sin plazos de Soza Bernard. No obstante, prometió gestionar ante el Servicio Penitenciario su pedido de traslado al pabellón Nº 16 de la cárcel de Piñero.
